General conditions and agreement clauses governing the use of GalaxyShell services

These terms of use govern the use of all services provided by GalaxyShell Internet Technologies ("GalaxyShell") through the galaxyshell.com and galaxyhosting.com.tr websites.
By visiting the GalaxyShell website, creating an account or purchasing any of our services, you declare that you have read, understood and accepted these terms of use.
Parties:
Individual customers must be at least 18 years of age. Legal entities are deemed to have accepted these terms through their authorised representative. A parent or legal guardian may open an account on behalf of a user under 18; in that case, all responsibility rests with the parent or guardian.
Service begins upon completion of the customer's order and confirmation of payment. Hosting and virtual server services are automatically activated within minutes. Dedicated servers and services requiring custom configuration are set up and delivered to the customer within the specified delivery period.
Services provided by GalaxyShell include:
Service fees are collected in advance for the payment period selected at the time of order (monthly, quarterly, semi-annual, annual).
Services are suspended for unpaid overdue invoices. No additional charge is applied for suspended services, however GalaxyShell is not responsible for data loss resulting from late payment.
Customers paying by bank transfer or EFT must submit the payment receipt via a support ticket. The customer number or invoice number must be included in the payment description.
GalaxyShell services may only be used for lawful purposes. The following activities are strictly prohibited and, if detected, service may be immediately terminated without notice:
A fair use policy applies to each account in shared hosting services. If excessive CPU, RAM or I/O usage is detected, the customer will be notified. If the issue persists, the account may be temporarily restricted or an upgrade to a higher-tier plan may be recommended.
When a rule violation is detected, GalaxyShell may issue a warning, temporary suspension or permanent account closure depending on the severity of the situation. For serious violations (illegal content, cyber attacks), service may be terminated immediately without prior notice and relevant legal authorities may be notified.
GalaxyShell may temporarily or permanently suspend service in the following circumstances:
After service termination, the customer's data is retained on the server for 7 days. During this period, the customer may request their data via a support ticket. After the 7-day period expires, all data is permanently deleted and cannot be recovered.
For shared hosting services, if you submit a cancellation request within 30 days of the service start date, your payment will be refunded in full. This guarantee applies only to first-time purchases of shared hosting packages; renewal payments are excluded.
For virtual server services, no refund is issued after the server has been set up and delivered, as resources have been allocated. However, in cases where the service cannot be technically provided and GalaxyShell is unable to resolve the issue within a reasonable time, a pro-rated refund for the unused period may be issued.
For dedicated server rental services, no refund is issued after setup and configuration is complete. Cancellation requests are processed at the end of the current billing period.
No refunds are issued for registered domain names. Domain registration is an irreversible transaction with international organisations (ICANN, Nic.tr, etc.).
No refunds are issued for activated software licenses (cPanel, Plesk, CloudLinux, etc.) or SSL certificates.
Where a refund is approved, it will be processed within 5–14 business days depending on the original payment method.
GalaxyShell's total liability arising from service disruptions shall not exceed the amount paid for the relevant service in the last 1 (one) month.
GalaxyShell cannot be held responsible for the following types of damage:
While GalaxyShell performs weekly automatic backups for hosting services, these backups are not guaranteed. The customer is solely responsible for maintaining regular backups of their own data. GalaxyShell is not responsible for data loss occurring for any reason.
GalaxyShell does not accept direct liability for issues arising from third-party software such as cPanel, Plesk, CloudLinux and LiteSpeed, but provides support to the customer during the resolution process.
Natural disasters, war, global-scale internet infrastructure failures, data center fires, power outages and similar events beyond the control of the parties shall be considered force majeure. During a force majeure event, the parties' obligations are suspended and neither party may be held responsible for delays or disruptions.
GalaxyShell guarantees 99.9% uptime for server and hosting services. In cases where the SLA commitment cannot be met, a service credit or service period extension proportional to the downtime will be applied to the customer's account. Planned maintenance windows are excluded from SLA calculations.
All content, logos, graphics, designs, software and trademarks on the GalaxyShell website are the intellectual property of GalaxyShell Internet Technologies. Unauthorised copying, reproduction, distribution or modification of these materials may result in legal action.
The customer guarantees that all content hosted on GalaxyShell servers complies with copyright and intellectual property rights. The customer is solely responsible for any content that infringes copyright.
Copyright infringement notices may be sent to [email protected]. GalaxyShell reserves the right to remove relevant content or block access in response to valid notices.
The use of third-party software provided through GalaxyShell (cPanel, Plesk, CloudLinux, etc.) is subject to the license agreements of the respective software vendors. The customer may only use this software within the scope of the applicable license terms.
GalaxyShell reserves the right to update and modify these terms of use at any time.
When significant changes are made, customers will be notified by email. Changes take effect on the date they are published on the website.
Continued use of the service after changes constitutes acceptance of the updated terms. If you do not accept the changes, you retain the right to cancel your service.
Price changes are notified at least 30 days before the end of the current subscription period. Active subscriptions continue at the purchased price until the end of the current period.

These terms of use and all relations between GalaxyShell and the customer are governed by the laws of the Republic of Turkey.
Antalya Courts and Enforcement Offices have jurisdiction over the resolution of any disputes arising from these terms.
The parties will first attempt to resolve any disputes in good faith through mutual negotiation. Disputes that cannot be resolved through negotiation may be referred to the competent court.
